General terms and conditions of sale

 

Clause n° 1: Object

 

These general terms and conditions of sale detail the rights and obligations of the sole trader Peggy Sengelin and her client for the sale of the following services:APE code 8690F: "Human health activities not elsewhere classified".

Any service performed implies that the client has read these GTC and adheres to them without reservation.

 

Clause n° 2: Price

 

Any service ordered is due by the client, including in the event of cancellation by the client before execution. For individuals, any service ordered is due in case of cancellation within less than two working days for individual sessions, and in full for session package orders.

 

Prices are in euros and calculated excluding taxes (VAT not applicable).

 

Clause n° 3: Payment, discounts, and rebates

 

Payment is made no later than the last day of the payment deadline mentioned on the invoice.

 

Payment methods: Check (payable to "Peggy Sengelin"), bank transfer, or cash (individuals only).

 

Deposits: Peggy Sengelin reserves the right to request a deposit before execution. For individual packages, remote sessions, or gift vouchers, the full amount may be requested in advance.

 

Refunds (Individuals): Refunds can be requested only if the session is canceled at least 2 working days in advance.

 

Individual Journeys/Programs: In case of cancellation without the possibility of rescheduling by Peggy Sengelin before the start, the full amount is refunded. If she cannot complete a journey in progress, a pro-rata refund for unperformed sessions will be issued. If interrupted by the client, no refund will be issued, and any outstanding balance remains due.

 

Group Accompaniment: If Peggy Sengelin cannot ensure the execution or rescheduling of a collective program, all sums received will be refunded, regardless of the stage of the journey.

 

Breach of Therapeutic Alliance: Peggy Sengelin reserves the discretionary right to terminate any accompaniment (individual or collective) in the event of non-compliance with the framework, systematic questioning of the therapeutic process, or inappropriate behavior. In this situation, no refund will be granted, and any unpaid amounts remain due.

 

Clause n° 4: Late payment

 

Late payments incur a daily penalty equal to three times the legal interest rate. A fixed indemnity for recovery costs of 40 euros is also applicable.

 

Clause n° 5: Damages and interests

 

Failure to pay within fifteen days of the implementation of the "late payment" clause may entitle Peggy Sengelin to damages and interests.

 

Clause n° 6: Force majeureLiability cannot be invoked if the non-execution results from force majeure (accidents, fire, strikes, COVID epidemic, etc.).

 

Clause n° 7: Competence clause

 

Any dispute is subject to French law. In the absence of an amicable resolution, the dispute will be brought before the court of STRASBOURG (67).

 

Clause n° 8: Logo usage

 

Peggy Sengelin is authorized to display the logos of partner companies on the website.

 

Clause n° 9: Accompaniment Framework and Responsibility

 

Nature of service: Services are holistic accompaniment for well-being and self-knowledge. They are not medical acts and do not substitute for medical treatment.

 

Contraindications: The client certifies they are not in an acute traumatic or psychiatric crisis. In case of severe disorder, a doctor's written advice is mandatory before any session.

 

Engagement and Discomfort: The client accepts to work within their "window of tolerance" and acknowledges that this work may involve temporary phases of discomfort. The client agrees to immediately report any major discomfort during somatic or breathwork practices.
